Attorney Eric Newmark’s client was convicted of conspiracy to commit mail fraud. She, along with 42 co-defendants, were charged in a 53-count federal indictment in the District of Minnesota alleging they conspired to defraud consumers through fraudulent magazine subscription sales. The Government alleged Newmark’s client was the owner of a company and was responsible for over $4,000,000 in fraudulent sales. Newmark’s client was facing a guidelines sentence of 108-135 months in prison. Newmark successfully argued to the Judge that his client was an “absentee owner” who did not oversee the management of the business. In addition, Newmark argued his client’s lack of record, acceptance of responsibility, and her exemplary behavior while on release called for a sentence without incarceration. The Court agreed, placing his client on supervision with no prison or jail sentence. Newmark’s client faced a maximum sentence of 30 years in prison.
