September 19, 2025 – Attorney Newmark Wins Dismissal on First Amendment Grounds

In a victory for free speech, Attorney Newmark won a dismissal of criminal charges as the Court ruled his client’s conduct was protected speech under the U.S. Constitution. Newmark’s client was criminally charged for using explicit and lewd language in a public space. Newmark successfully argued that Minnesota’s Disorderly Conduct statute could not be used to punish speech other than “fighting words” and successfully argued that his client’s speech did not constitute “fighting words” under the law. In today’s climate, where free speech is under threat from Government officials, this significant victory is an important vindication of free speech rights.
